OHRC working to ensure equality in the education system

On September 6, 2023, the Ontario Court of Appeal granted the Ontario Human Rights Commission (OHRC) leave to intervene in the case of Ontario Teacher Candidates’ Council et al. v Ontario (Ministry of Education).

At issue in this appeal is whether the Mathematics Proficiency Test and related legislation established by Ontario for teacher accreditation discriminates on the basis of race, contrary to s. 15 of the Canadian Charter of Rights and Freedoms.

The Divisional Court has previously ruled that the test and related legislation are unconstitutional. The Ontario government has appealed that decision to the Court of Appeal.

The OHRC is intervening in the appeal as part of its longstanding work to challenge systemic discrimination in the education system, and to ensure that historically disadvantaged groups are protected from rules and laws that adversely affect them.
